This website version provides the current accessible policy text. Where a separately accepted or signed agreement applies, that agreement and any non-waivable law also govern.
Who we are and what this notice covers
Indigenous Tunes is a South African music distribution and artist-services company serving artists, record labels and music businesses internationally. This notice applies to personal information processed through indigenoustunes.com, our customer and artist service journeys, support interactions and related business activities.
Different laws may apply depending on the person, activity and jurisdiction. References to regional rights apply only where the relevant law covers the processing.
Information we may collect
Depending on the service used, we may process:
- identity and contact details supplied by an artist, label representative, customer or business contact;
- account and authentication information handled through the Artist Platform or Client Portal;
- artist, label, contributor, songwriter, publisher and rights-holder information;
- release metadata, audio, artwork, identifiers and ownership declarations;
- billing, transaction and payment-verification information, while payment-card details may be handled directly by a payment provider;
- support messages, service requests and documents submitted for distribution, publishing, licensing, radio or artist services;
- website usage, device and consent information where permitted; and
- marketing preferences and communications.
We aim to collect information that is relevant to a defined purpose and not excessive for that purpose.
South Africa publishing and rights application
The South Africa Publishing & Rights Registration application is hosted within the Indigenous Tunes Client Portal and embedded on the public website. Depending on the selected workflow, it may request identity and contact details, company information, rights-ownership information, banking information and supporting documents needed for applicable registration or administration assistance.
The public website analytics layer records only page, iframe-load and approved link events. It does not read, copy or track the values entered into the embedded application.
Why we process information
Information may be used to create and administer accounts, evaluate and deliver requested services, distribute eligible music, communicate about releases and support, manage rights and licensing enquiries, administer billing and royalties, prevent fraud and infringement, meet legal obligations, protect our services, improve website and support experiences, and send marketing only where permitted.
The applicable processing basis may include performance of a contract, steps requested before entering a contract, consent, compliance with law, protection of legitimate interests, or another lawful basis recognised in the relevant jurisdiction.
Service providers and recipients
Information may be shared with service-provider categories that support distribution infrastructure, digital music delivery, hosting and cloud services, customer support, communications, analytics, fraud prevention, professional advisers, payment processing, accounting, rights administration, broadcasters or licensing workflows. We disclose only what is reasonably required for the relevant purpose and expect providers to protect the information they process.
Release metadata and credited contributor information may become public through digital music services as part of the distribution requested by the account holder.
International and cross-border processing
Indigenous Tunes serves an international music market and may use infrastructure or service providers located outside the country where information was collected. Where cross-border processing occurs, we take steps appropriate to the information, destination and applicable law. We do not claim a particular statutory transfer mechanism unless it has been confirmed for the relevant processing activity.
Retention and security
We retain information for as long as reasonably required for the service, contractual records, rights and royalty administration, dispute handling, fraud prevention, legal obligations and legitimate record-keeping. Retention periods vary by record type and applicable law.
We use proportionate organisational and technical safeguards. No online system can be guaranteed completely secure; suspected security concerns should be reported promptly through the Client Portal or the contact route on this website.
Your privacy rights
Where applicable under the laws of your jurisdiction, you may request access, correction, deletion, restriction, objection, portability or withdrawal of consent. Rights can be limited by lawful exceptions, verification requirements and records that must be retained.
Use the Privacy Rights Request page for the current request options. Marketing choices may also be changed using the unsubscribe route included in a marketing message.
South Africa — POPIA
For processing governed by the Protection of Personal Information Act 4 of 2013, Indigenous Tunes acts as the Responsible Party where it determines why and how personal information is processed. Operators and service providers may process information on our behalf for defined services.
Our framework addresses purpose specification, processing limitation, information quality, openness, security safeguards, data-subject participation and responsible cross-border processing. Access, correction, objection and deletion requests remain subject to POPIA and other applicable law.
Information Officer particulars will be published after the formal designation details are available. Until then, privacy assistance can be requested through the Privacy Rights Request page or the general company contact route.
Individuals may also obtain information from or submit an eligible complaint to the Information Regulator (South Africa).
European Economic Area and United Kingdom
Where EU or UK data-protection law applies, individuals may have rights to information, access, correction, deletion, restriction, objection, portability and safeguards around certain automated decisions. Indigenous Tunes will identify an appropriate lawful basis for covered processing and provide any additional notice required for that activity.
UK rules on storage technologies and electronic communications may also apply to cookies and direct marketing. Non-essential website technologies remain controlled through Cookie Settings where consent is required.
California
Where the California Consumer Privacy Act, as amended, applies to Indigenous Tunes and the processing, California residents may have rights to know, access, correct or delete information, opt out of covered sale or sharing, limit certain uses of sensitive information, and receive equal service when exercising their rights.
Indigenous Tunes does not use this notice to claim that the CCPA applies to every interaction. Requests may be submitted through the privacy-request route and will be assessed under the law that applies.
Children and account eligibility
Account eligibility depends on the applicable distribution service, contract capacity and local law. A person who cannot enter the relevant agreement independently must use the service through an authorised parent, guardian or other legally permitted representative. The Artist Platform may apply additional eligibility and verification requirements before an account can be activated.
Questions and complaints
Use the Privacy Rights Request page for privacy assistance. Existing customers may also use the Client Portal. Complaints may be raised with the applicable supervisory authority where the law provides that right.
